Terms of Use
Last updated: Oct 23, 2026
1. About these terms
Welcome to Pivot! These Terms of Use ("Terms") govern your use of thepivotway.com (the "Site") and the coaching, workshops, digital products, and other services we offer (together, the "Services"). The Services are provided by ThePivotWay LLC, a California limited liability company ("Pivot," "we," "us," or "our").
By using the Site or any Services, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Site or Services.
Some Services have their own terms, including our Coaching Terms (one for each coaching package) and our Workshop Terms. When you buy or sign up for one of those Services, its terms apply along with these Terms. If they conflict, the Service-specific terms win for that Service.
2. General Disclaimer
Everything we offer is for educational and informational purposes. Our coaching, workshops, and resources are career guidance. They are not legal, financial, tax, medical, or mental health advice, and Pivot is not a recruiter, staffing agency, or job placement service.
We can't guarantee any outcome, including interviews, job offers, promotions, or a specific salary. Your results depend on your own effort, background, and job market conditions. You're responsible for the decisions you make based on our Services.
3. Eligibility
You must be at least 18 years old to use the Site or Services. By using them, you confirm that you meet this requirement.
4. Coaching Services
Coaching is delivered by Pivot through our own coaches or coaches who work with us. Each coaching package has its own Coaching Terms that cover scope, scheduling, cancellations, and refunds. You'll see and accept them before you purchase.
Coaching often involves reviewing materials you share, such as your resume, portfolio, or LinkedIn profile. You keep ownership of everything you share. You give us permission to use it only to deliver your coaching.
5. Workshops
We offer free and paid workshops. Our Workshop Terms cover registration, refunds, and attendance.
Recording. We may record workshops and share recordings with attendees or use them to improve our Services. We'll tell you at the start of any session that's being recorded. If you don't want to appear in a recording, you can keep your camera and microphone off, use the chat, or skip that session. By staying in a recorded session with your camera or microphone on, you agree to be recorded.
Conduct. Please be respectful of other attendees. Don't record, screenshot, or share other attendees' information or contributions without their permission. We may remove anyone who disrupts a session, without a refund.
Changes. We may reschedule or cancel workshops. If we cancel a paid workshop and don't offer a new date that works for you, we'll refund you in full.
7. Intellectual Property
Everything on the Site and in our Services, including our logo, brand name, Playbook, templates, guides, videos, workshop materials, recordings, and copy, belongs to ThePivotWay LLC and is protected by copyright, trademark, and other intellectual property laws.
You may view and download content for your personal, non-commercial use.
You may not:
-
Copy, share, resell, republish, or distribute our content without written permission
-
Claim ownership of any part of our content
-
Use our name, logo, or materials in a way that suggests endorsement or affiliation
If you'd like to license our materials or collaborate, contact us at support@thepivotway.com.
8. Payments
All prices are in U.S. dollars unless noted otherwise. Payments are processed through Wix and its third-party payment providers, which have their own terms. We may change our prices at any time, but changes won't affect anything you've already paid for.
You agree to give accurate payment and contact information and authorize us to charge your payment method for your purchases. If you buy a coaching package with installment payments, its Coaching Terms explain the payment schedule.
9. Refunds and Cancellations
-
Digital products: Because they're delivered instantly, all sales are final unless the product description says otherwise.
-
Coaching: See your package's Coaching Terms for details.
-
Paid workshops: Refunds and transfers are covered in our Workshop Terms.
10. Testimonials and Affiliate Links
We share client stories and testimonials with their permission. They reflect individual experiences, and they aren't typical results or a promise of what you'll achieve.
Some content includes affiliate links. If you buy through one, we may earn a commission at no extra cost to you. We only recommend tools and resources we believe in, and we label affiliate links where they appear.
11. User Conduct
You agree not to:
-
Break any laws while using the Site or Services
-
Use the Site to spam, hack, or interfere with others
-
Upload or send malicious code or harmful content
-
Harass coaches, staff, or other participants
We may restrict, suspend, or end your access if you violate these Terms.
12. Limitation of Liability
To the fullest extent the law allows, Pivot and its owners, coaches, and contractors aren't liable for any indirect, incidental, consequential, or punitive damages from your use of the Site or Services.
Our total liability for any claim related to the Site or Services won't exceed the amount you paid us in the 12 months before the claim.
13. Indemnification
You agree to defend and hold harmless Pivot and its owners, coaches, and contractors from any claims, damages, or expenses (including reasonable legal fees) that come from your use of the Site or Services or your violation of these Terms.
14. Termination
We may suspend or end your access to the Site or Services at any time, including if you violate these Terms. When access ends, you must stop using our materials.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we'll change the Effective Date at the top. If you keep using the Site or Services after an update, you accept the new Terms.
16. Disputes and Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules.
If you have a concern, please email us first so we can try to resolve it informally. If we can't resolve it within 30 days, either of us may bring the dispute in the state or federal courts located in San Francisco County, California.
